He who knows the value of waqf is a visionary, a noble who has good principles, and who is great in his values.
In the Muslim tradition, the Waqf (plural Awqaf, also hobs, hobos or habas, habis) is, mainly, a device of allocation of the returns of a private property in the service of the general interest. Islam encourages Muslims to assume some societal responsibility within the community in which they live.
Thus, he recommends a certain number of devices likely to strengthen proactive solidarity not only with regard to the Muslim community, but also towards humanity as a whole.
Among these legal devices are the Zakat (obligatory alms / purifying of wealth from the spiritual point of view), the Sadaqas who present themselves as optional alms and the Waqf which is the subject of all our attention.
Literally, the word Waqf, in the plural Awqaf, is diverted from waqafa that means: to stop or immobilize. In muslim jurisprudence, the waqf is the solid act to block a property to put it under cover, notably of a sale or of an inheritance, in order to consecrate the pulled dividends of his exploitation to a charitable end.
In certain muslim countries, the waqf carries the name of habis, in the plural habous. One there finds notably ministries called Ministry of habous which comes back to awqaf.
The Waqf was the focal point for the financing of socio-religious systems and public welfare during the early days of Islam. He played a considerable role in the socio-educational, cultural and solidarity aspects for Muslims.
The majority of jurists consider the Waqf a recommended benevolent act (tabarru` Mandub) as a basis for contributing to just philanthropic causes (jihat al-birr / wujuh al-Khayr) and which is recommended by the textual sources, namely the Qur’an. and the Sunnah.
The waqf system is a system used in most Muslim countries. There are many achievements that have emerged from the awqaf, from its origin in the time of the Prophet (), to the present day.
But this system has declined because states have taken over the organization of society in general.
The waqf is defined as a contract stipulating a perpetual usufruct donation of a productive asset, made by a natural or legal person. This is remove a property from private property and prevent it from falling while intending to usufruct to a specific charity or public interest.
